Terms of Service for Insula App

Effective Date: January 1, 2026

Welcome to Insula! These Terms of Service (“Terms”) govern your access to and use of the Insula mobile application (the “App”) and any related services provided by the operators of the Insula App (“we,” “us,” or “our”).

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy (Version 1, referenced below). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using the App, you confirm that you have read, understood, and agree to these Terms, including the policies referenced herein, and any future amendments. You must be at least 13 years of age, or the minimum age of digital consent in your jurisdiction, to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from your parent or legal guardian to use the App.

2. Privacy Policy Reference

Your use of the App is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, and protect your personal information. Please refer to the separate Insula Privacy Policy document for full details regarding data handling, collection, storage, and security practices. By agreeing to these Terms, you also acknowledge and agree to the terms of our Privacy Policy.

3. User Accounts and Responsibilities

3.1 Account Creation

To access certain features of the App, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Notify us immediately of any unauthorized use of your account.

3.2 User Conduct

You agree not to use the App to:

  • Violate any applicable law or regulation.
  • Infringe on the rights of any third party, including intellectual property, privacy, or contractual rights.
  • Transmit any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation (spam).
  • Transmit any computer viruses, worms, defects, or other items of a destructive nature.
  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Collect or track the personal information of others.
  • Attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App.

4. Intellectual Property

The App, including all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by operators of Insula App its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use, subject to these Terms.

5. Termination

We may terminate or suspend your access to all or part of the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App and/or follow the account deletion procedures within the App settings.

6. Disclaimers and Limitation of Liability

6.1 App Provided “As Is”

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATORS OF THE INSULA APP BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE APP.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
